Introduction and Acceptance of Terms
Welcome to Possession ("we," "us," "our"). These Terms and Conditions ("Terms") govern your use of our peer-to-peer rental service via our mobile application ("App"). The App enables users to list and rent various items within the Calgary metropolitan region. ("Service").
By registering or using the Service, you agree to these Terms, including any future updates. Please read carefully.
User(s): Anyone using the Service, whether as a Owner (person renting out an item) or Renter (person renting an item).
You: Refers to the User accessing or using the Service.
Possession: The operator of the Service, incorporated in Calgary, Alberta.
Eligibility and Registration
3.1 You must be at least 18 years old and legally able to enter into contracts in Alberta.
3.2 To register, you must provide accurate and current information, which may include government-issued ID verification through our app.
3.3 You are responsible for maintaining the confidentiality of your account and password, and for all activities under your account.
3.4 You agree not to share your login credentials or allow unauthorized third parties to use your account.
Use of Service and Listings
4.1 Possession acts solely as a platform connecting Owners and Renters; Possession is not a party to rental agreements.
4.2 All listings must accurately describe the item, condition, rental terms, and pricing.
4.3 Users must comply with all applicable laws when creating listings and renting items.
4.4 Advertising or listing illegal, offensive, or misleading items is strictly prohibited.
4.5 Possession reserves the right to remove or modify listings that violate these Terms or appear inappropriate.
5.1 Bookings occur when an Owner confirms a rental and after a Renter pays via the App using a valid payment method.
5.2 Payments are processed securely through a third-party payment provider (e.g., Stripe).
5.3 In the event an Owner fails to provide the item as agreed, and no alternative arrangement is reached, Possession will refund the Renter.
6.1 Possession charges:
A service fee of 15-25% of the rental price to the Owner.
A booking fee of 15-25% of the rental price by the Renter.
6.2 Avoiding these fees by transacting outside the App may result in suspension or termination of your account.
Cancellations and Refunds
7.1 If the Owner cancels, the Renter receives a full refund.
7.2 Refunds are processed by the payment provider and may take 5–10 business days.
8.1 Delivery and return details are agreed directly between the Owner and Renter.
8.2 Late returns must be communicated immediately. Additional fees may apply.
8.3 Failure to return items on time or communicate may result in Possession withholding deposits or taking further action.
9.1 As a user, you must comply with all applicable laws and these Terms when using the Service.
9.2 As a user, you are responsible for your behaviour and interactions with other Users.
9.3 As a user, you guarantee you have the rights to list any item you advertise.
9.4 As a user, you agree not to use the Service for unauthorized commercial activities or fraudulent behaviour.
9.5 As a user, you agree to indemnify Possession against any claims arising from their misuse of the Service.
9.6 Owners are responsible for, listing and renting out item(s).
9.7 Owners are responsible for, providing accurate and complete information about the item, including its condition, features, limitations, and any known defects.
9.8 Owners are responsible for, ensuring the item is reasonably safe and suitable for its intended use at the time it is provided to the Renter.
9.9 Owners are responsible for, providing the item to the Renter as described in the listing and agreed rental terms.
9.10 Owners are responsible for informing the Renter of any relevant operating instructions, safety requirements, or restrictions known to the Owner.
9.11 Owners are responsible for, promptly reporting any issue involving damage, loss, theft, or misuse of an item to Possession.
9.12 Owners are responsible for, complying with all applicable laws, regulations, and requirements relating to items they list on the Service.
9.13 Renters are responsible for using rented items responsibly and taking reasonable care of rented items while they are in the Renter's possession.
9.14 Renters are responsible for, following any instructions, warnings, or safety requirements provided by the Owner or manufacturer.
9.15 Renters are responsible for returning the item within the agreed rental period and in substantially the same condition in which it was received, except for reasonable wear and tear.
9.16 Renters are responsible for promptly notifying Possession and the Owner of any damage, loss, theft, or other material issue involving the rented item.
9.17 Renters are responsible for paying any applicable rental charges, fees, deposits, damage charges, or other amounts owed under the rental agreement.
9.18 Renters are responsible for, not allowing unauthorized individuals to use the rented item where the rental terms prohibit such use.
Possession Responsibilities
10.1 Possession provides and operates the marketplace through which Owners and Renters can connect and arrange rentals.
10.2 Possession may facilitate payments, communications, delivery arrangements, dispute reporting, and other marketplace services where those services are offered through the Platform.
10.3 Unless expressly stated otherwise, Possession does not own the items listed by Owners and does not control the condition, quality, safety, legality, or suitability of items listed by Users.
10.4 Possession may review reported issues and take reasonable action under these Terms, including requesting information from Users, removing listings, restricting accounts, processing refunds where applicable, or taking other action permitted by these Terms
Damage, Loss, and Disputes
11.1 If an item is damaged, lost, stolen, or not returned as required, the Owner or Renter must promptly report the issue to Possession.
11.2 Possession may request information or documentation from the parties, including photographs, descriptions of the item's condition, receipts, or other relevant information, to assist in reviewing a reported issue.
11.3 Where applicable, Possession may facilitate the resolution of disputes or the collection or payment of amounts owed under the applicable rental terms.
11.4 Nothing in these Terms makes Possession the owner of a rented item or a party to the rental agreement between an Owner and Renter, except where Possession expressly agrees otherwise in writing.
12.1 Owners are responsible for insuring their rental items unless covered by Possession’s insurance.
12.2 Owners must take reasonable care of rental items and are liable for damage caused by negligence or intentional acts.
12.3 Possession limits liability to the fullest extent permitted by law and is not liable for indirect, incidental, or consequential damages.
12.4 Owners and Renters acknowledge that rental transactions involve items owned or controlled by Users. Each User is responsible for their own acts and omissions in connection with a rental.
12.5 Possession does not guarantee that an item will be available, safe, suitable, functional, or free from defects, except where Possession expressly provides such a guarantee.
12.6 Owners remain responsible for the accuracy of their listings and for complying with their obligations as an Owner. Renters remain responsible for the proper use, care, and timely return of rented items.
12.7 Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable Alberta or Canadian law or limits your statutory rights as a consumer in Alberta.
13.1 We collect and process personal data necessary to operate the Service, including contact info, payment data, location, and transaction history.
13.2 Data is processed in compliance with Canadian privacy laws (PIPEDA).
13.3 We share your data only with service providers and partners under strict confidentiality (e.g., payment processors, insurance providers, cloud services).
13.4 You may request access, correction, or deletion of your personal data by visiting the User Data Deletion page.
14.1 All content, software, and trademarks in the App are owned or licensed by Possession.
14.2 Users may use the Service only as permitted and may not copy, modify, or redistribute Possession’s intellectual property.
Termination and Suspension
15.1 Possession may suspend or terminate your account without notice for violations of these Terms, abuse, or legal reasons.
15.2 You may terminate your account by contacting support.
Dispute Resolution and Governing Law
16.1 Parties will attempt to resolve disputes informally.
16.2 Any unresolved dispute will be governed by the laws of Alberta, Canada, and submitted to courts located in Calgary.
16.3 This includes disputes involving the validity, interpretation, or enforcement of these Terms.
No Class Actions / Jury Trial Waiver
17.1 You agree to resolve disputes individually and waive rights to participate in class actions or jury trials related to the Service.
17.2 Arbitration or court proceedings will be on an individual basis only, unless Possession agrees otherwise.
18.1 Possession may update these Terms from time to time. We will communicate material changes via email or in-app notification. Continued use after changes means you accept the updated Terms.
